The Harrison Act was passed in 1914, and is the closest regulation I can find for the sale of a class of drugs called "exempt narcotics." At some pharmacies, you can purchase guaifenesin with codeine (Robitussin AC, Cheratussin) without a prescription at the discretion of the pharmacist, so long as you sign a book like the one pictured with your name, license number, address, etc (similar to when you purchase sudofed).
Here are all the problems with the above:
The Harrison Act was passed in 1914. I would be floored if it supersedes the Controlled Substances Act, which schedules Cheratussin as a controlled substance, particularly since it allows for the OTC sale of heroin.
Supposedly, some states have laws that allow for the OTC sale of certain codeine-containing prescription products, including Cheratussin. This is akin to states legalizing marijuana -- it's technically illegal, since federal law supersedes state law... that is, unless the Harrison Act is still legitimate. In which case...
Now I can sell Cheratussin! Except now I'm the pharmacy that sells codeine over the counter.
I retired my exempt narcotic book because Alaska law doesn't describe the sale of narcotics over the counter, federal law is too vague, and one out of the two people who ever asked me for it OTC was a drug seeker. That said, I dispense it prescription all the time. If your cough is bad enough to require codeine, you should probably see a doctor anyway.
